Hi,
Yesterday I got the response for my SR opened on 10/16 for still not receiving FP notice yet. The letter says that the processing on my case has been delayed since the background check on my application is still open. Please contact after 6 months if you still haven't heard back from us. My assumptions are:
1. Since they did not mention any where in the letter about biometrics, they are talking about my 485 petition and not my finger printing notice. Guess they misunderstood why I opened the SR with them. Does that make sense?
2.Is it possible that I haven't received FP notice since my background check is still in progress? I thought that these were two independent process...
Any suggestions would be appreciated!

We filed our application on 5/31. Reached USCIS on 6/1.
Our attorney office informed us some of checks got cashed for some of us( whose 140 is pending not yet cashed) but still none of us received notice letter. Those who got early receipts may be lucky. But I think 3 weeks are reasonable. Since we are current for next month also we no need to be panic on receipts.

When the cases gets shuffled around the country from NSC to CSC and back, the dtabases are separate. FP notices are generated when information on different databases are alligned together.

4. Good savings (all said and done, your bank balance is very important no matter where you stay in the world)

I am in the process of applying for EAD renewal. I have few questions:
On the I-765 form,
Q.11 if applied for EAD before , complete below.
But there is nothing below other than your signature and date. It does not ask you of previous EAD information. What does "complete below" means?

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...
I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.
SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.
The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.
Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?
Think Positive- that's the first prerequisite for positive things to happen.

I worked with a MNC for 4 yr 10 months at US soil and they ruined my GC saying that they want me more at Offshore (India ).... I got intelligence about this planning about 3 months earlier from a real good friend of mine ... So i arranged a H1B Job with a Desi consulting company in this 3 months and when they asked me to go back To India - you know what finger i've shown them.
Now this desi consulting company kept their words with salary,applied for LC quickly( because my H1 was close to 6 yrs) and i'm with them for 2.5 yrs . Now when i reached them for a employer letter for 485 they changed colors and asked me to sign a 10K bond for staying with them 1 year after GC ( which is an indeterminate period given retrogression)
Which employer would you call better ?? :)

My wife and I just got receipts for our I-485, I-140, AP and EAD. The "received date" is July 7 and the "Notice Date" is September 13. I also confirmed that the checks were cashed.
I remember my attorney saying that the applications were filed at NSC but somehow my receipts came from VSC. And this morning I receive an update that my I-485 has been transferred to TSC! Here is the detail:
"On September 20, 2007, we transferred this I485 APPLICATION TO REGISTER

I will give you a sincere and useful suggestion, that hopefully will be valid to others as well. Please refrain from pulling the race card on people talking about immigration. That makes you look emotional, character assassin and worse, that can make people perceive you as a racist yourself. That is the failed tactics used by illegal aliens and uneducated people when confronted with the reality that their attitude and posture is irrational. As far as I can tell, NumbersUSA objects against Irish people who came here illegally. Therefore I do not see any correlation between racial profiling there as you seem to persist. I am not here to defend NumbersUSA or Lou Dobbs. I am just here to remind you that if we continue following the rationale "us vs them" and doing character assassination, we will undeniably face rough opposition and struggle to get what we deserve.

Talk about your scare of getting too many people with substandard MS degrees. Do you not realize that the companies in USA knows a different in good US school and Bad one - So in nutshell the people from bad school wont get job? Do you know that there is nature's rule - Fittest Survival... So in case you are fit enough and qualified enough to get a job then you will get one, it does not matter if you are from good or bad school....
Also, looking at your thoughts, it does not appear that you are MIT or Stanford grade material, so do us all a favor and keep your thoughts to yourself....

They want their mexican maid or indian computer programmer doing things for them but the moment they realize that these foreigners might get citizenship and be equal to them, they dont like that.... You can view my past posts in IV, I am not Desi employer but I may become very soon to employ myself (very close to get GC :-) )
Anyway have you gone through yourself with same situation/tension as OP going through or do you know someone closely who have gone through? Have you dealt with attorney yourself?
If that employer sue you, definitely you can counter sue for violation of wage related or h1b related rules and attorney will be the best person to advice you on that. make sure you go to an attorney who practice employement laws and have knowledge or have some other attorney in the same firm who deals in immi related matter. But question is, do you want to go through nightmare of law suites or you just want peace of mind.
